This application or website (this “Site”) is owned or controlled by Intellectual Reserve, Inc. (“IRI”, “we”, “us”, or a similar term), a nonprofit organization affiliated with The Church of Jesus Christ of Latter-day Saints (the “Church”). The liability and obligations of IRI in connection with any information, content, images, writings, or other materials of any kind that you contribute to this Site (collectively and individually, “Content”) are strictly limited by this Content Submission Agreement and the Terms of Use (collectively, this “Agreement”). By submitting, contributing, or posting any Content, you agree to all terms and conditions of this Agreement.
- You are Responsible for Your Content. You acknowledge that any Content you submit to this Site has been created or selected at your sole discretion and that your submission of Content is made at your direction and not at the direction of the Church, IRI, or any affiliated entity. All Content you upload to this Site may potentially be available for others to search, view, hear, and otherwise use in accordance with this Agreement. Do not contribute any Content that you do not want others to access.
- Right to Submit. By submitting Content to this Site, you affirm that you have the legal right to do so and that use of such Content in accordance with this Agreement will not violate any third party’s privacy rights, publicity rights, contract rights, copyrights, or other rights. You accept legal responsibility for your Content, as well as for our (and our sublicensees’) use of your Content.
- Licenses and Rights Granted to Us. You grant IRI an unlimited, irrevocable, non-exclusive, worldwide, perpetual, royalty-free, fully-paid-up, sublicensable, and transferrable license to (and to allow others to) reproduce, distribute, create derivative works from, display, perform, transmit, and otherwise use your Content in any number, language, and manner, and by any means now known or later developed.
- Moral Rights. You waive and will not enforce or assert any and all so-called moral rights of any kind (including rights of paternity, integrity, attribution, disclosure, withdrawal, or similar rights) now or hereafter recognized, in any jurisdiction, with respect to your Content.
- Publicity. You consent to the unlimited use of your name, image, story, and likeness as included in your Content in perpetuity and throughout the world, by IRI, its sublicensees, and users of this Site in accordance with this Agreement. You may not submit Content pertaining to other living individuals (e.g., whose name, image, story, or likeness appears in the Content) unless such individuals have given you their consent to submit it to this Site, or if an individual is a minor, the minor’s parent or legal guardian has granted such consent.
- Accuracy of Contributed Data. You agree to provide true, accurate, and complete information to us. If any of your Content is, in our sole discretion, false or misleading, we will have the right, but not the obligation, to take any remedial or preventative action we deem appropriate, including restricting access to or deleting your Content. You agree to ensure that your Content accurately depicts the individuals shown and discussed therein (e.g., the Content has not been modified to alter anyone’s appearance; it does not impersonate others, contain caricatures, etc.).
- Sensitivity to Other Users. We ask you to be selective in submitting your Content. We reserve the right to remove any Content which we believe, in our sole discretion: (a) is irrelevant; (b) is potentially harmful or embarrassing to any living person; (c) is offensive, indecent, inappropriate, threatening, or abusive; (d) infringes the rights of any third party; (e) is illegal; (f) is contrary to the teachings of the Church; or (g) otherwise violates this Agreement. We may also take any action, including restricting your access to this Site and notifying law enforcement, for any activity that appears to violate applicable law.
- Automated Screening. We reserve the right, without obligation, to monitor, suppress, and/or delete your Content for any or no reason. We may use automated filtering tools to suppress Content which appears in our best judgment to violate this Agreement.
- Care of Submissions. We intend to use reasonable efforts to preserve the integrity of your Content and to avoid errors or omissions on this Site. We provide the opportunity to submit Content subject to this Agreement. This Site and all related services are provided “AS IS”, and we are not responsible or liable for errors or omissions in any content you may find on this Site, or for any loss, damage, or corruption of your Content. Additionally, once we have sublicensed your Content to others, we may not be able, and we will have no obligation, to have such sublicensees stop using such Content. We are not liable for any special or consequential damages resulting from or relating to your Content.
- Data Protection and Processing. If you are located outside the U.S.A., you consent to the processing in the U.S.A. of any personal data that you submit. You also agree to comply with all applicable laws regarding the transmission of personal information to or from the U.S.A. and the country in which you reside. You also authorize IRI and its affiliated entities to collect, process, transfer to other countries and legal entities, and otherwise use your personal information as included in or associated with the Content, in accordance with the Church’s Privacy Notice, which is incorporated into this Agreement.
- Additional Restrictions. You may not submit Content that appears to promote any product or service. Further, Content must not express political statements or cast any individual or entity in a false or negative light.
