By using this Store, establishing a user account with the Store (“LDS Account”), or by purchasing products from the Store, you agree to follow and be bound by these Terms. If you disagree with any of the conditions, do not use this Store. These Terms may change from time to time, so please check for changes when you use the Store. Your continued use of the Store following the posting of changes to the conditions constitutes your acceptance to those changes.
General
These Terms constitute a binding legal contract between CPB and you, the LDS Account holder, the user of the Store, and/or the purchaser. These Terms apply to all offers, sales, and purchases from the Store or other websites or mobile applications that link to or reference these Terms.
We attempt to describe the products that are available for purchase through the Store as accurately as possible. However, we do not warrant that the product descriptions, prices, anticipated delivery dates, and representations about availability made or referred to on the Store are accurate, complete, reliable, current, or error-free. If a product offered in the Store is not as described, your sole remedy is to return it in unused condition.
While we make every effort to ensure that items appearing on the Store are available, we cannot guarantee that all items are in stock or immediately available when you submit your order. We may reject your order (without liability) for any or no reason in our sole discretion. If this is the case, we will refund any prior payment that you have made for that item.
User Accounts
When using the Store, you may choose to either create an LDS Account to store your information for future visits, or you may check out as a guest. Some items on the Store may only be purchased by individuals who have an LDS Account and we may require you to meet other criteria. See Store Help for details.
Product Information
Occasionally, there may be information on our Store that contains typographical errors, inaccuracies, or omissions that may relate to product descriptions, pricing, anticipated delivery dates, and availability. We reserve the right to correct any errors, inaccuracies, or omissions and to change or update information or cancel orders if any information on the Store is inaccurate at any time without prior notice (including after you have submitted an order via the Store).
Prices and Payment Terms
Prices generally include standard shipping, value added taxes, and customs duties, unless otherwise indicated.
If the price of a product is obviously incorrect, regardless of whether it is an error in a price posted on the Store or otherwise communicated to you, then we reserve the right, at our sole discretion, to cancel your order and refund to you the amount that you paid, regardless of how the error occurred. A contract between us will only be formed after you have ordered your product(s), you have confirmed your acceptance to these Terms, we have received payment, and we email you confirming the transaction (which is our acceptance of the transaction). We reserve the right to reject or cancel your transaction without reason at any time, provided that if we reject or cancel a transaction after payment has been made, we will return such payment.
Returns and Exchanges

Delivery
Delivery will be to a valid address submitted by you. You must check the delivery address on any order acknowledgement we provide, and notify us of errors or omissions as soon as possible. The risk of loss of or damage and title to the products passes to you when the items are delivered to you.
Licenses and Restrictions
All material found at this Store (including visuals, text, icons, displays, databases, media, and general information) is owned or licensed by us, other entities institutionally affiliated with The Church of Jesus Christ of Latter-day Saints (the “Church”), or other third parties. Our rights to the Store, the designs, trademarks, service marks, and other trade names displayed on the Store, are our property or the property of our licensors, and are protected by copyrights, trademarks, patents, or other proprietary rights and laws. You are granted a nonexclusive, nontransferable, revocable, limited license to view, copy, download, and print material from this Store only for your personal, noncommercial use unless otherwise indicated. Code of Conduct

You agree to do nothing that might disrupt the flow of data to and from this Store, impact the service or performance of this Store, or circumvent any of the controls or usage rules that we have implemented. You understand that the result of harmful or offensive actions may include revocation of your right to use this Store and legal action against you.

Dispute Resolution
In the event of any dispute arising out of or relating to these Terms, including, without limitation, formation, validity, interpretation, construction, operation, performance, breach and associated remedies, termination or cancellation, and enforcement (a “Dispute”), the parties shall use their best efforts to settle the Dispute through correspondence, mutual consultation, and other mediating efforts. Any Dispute that is not able to be resolved in this manner shall be settled exclusively by binding arbitration at Frankfurt, Germany under the arbitration rules of the International Chamber of Commerce (“ICC”). All arbitration proceedings hereunder, including submissions, documents, statements, and testimony, will be in the English language, before an arbitration tribunal made up of three arbitrators, one of which will be selected by each of the parties and the third of which will be selected by the other two arbitrators. If the two arbitrators are unable to agree on the selection of the third arbitrator within thirty days, the third arbitrator will be selected according to the rules established by ICC. The decision of the arbitrators shall be final and binding upon the parties, not subject to appeal and shall deal with the questions of costs of the arbitration and all matters related thereto. Judgment upon any arbitral award may be entered and enforced in any court of competent jurisdiction. The arbitral tribunal is not authorized and shall have no power to award punitive, exemplary or multiplier damages, and the parties hereby waive and disclaim any right to seek or recover the same. These Terms and any Dispute will be governed by the laws of Germany, except for its conflict of laws rules. In the event either party commences any arbitration proceedings or other legal action arising out of or relating to these Terms, the prevailing party in such proceeding will be entitled, in addition to any other rights and remedies it may have, to recover its costs and attorneys’ fees incurred in such proceeding from the other party.
Limitations of Liability
WE ARE NOT LIABLE FOR ANY SPECIAL OR CONSEQUENTIAL DAMAGES RESULTING FROM YOUR USE OF, OR YOUR INABILITY TO USE, THE MATERIALS IN THIS STORE OR ANY LINKED SITE, INCLUDING, BUT NOT LIMITED TO, LOST PROFITS, BUSINESS INTERRUPTION, AND LOSS OF PROGRAMS OR OTHER DATA ON YOUR INFORMATION HANDLING SYSTEM. CPB, in its sole discretion, may terminate these Terms with you for any or no cause, at any time, by written notice to you, which shall be effective immediately or as specified in the notice. Notice will be sent to the contact information specified in your LDS Account or provided by you at the time of checkout. After termination, you shall no longer have access to the Store. The provisions of these Terms which by their intent or meaning are intended to survive such termination shall continue to apply indefinitely.
